Adoption is when the parental rights of a child are taken from the birth parents or current guardians and given to adoptive parents. In the state of Illinois, all adoptions are governed by the Illinois Adoption Act. Any child who has resided in the state for at least six months may be adopted and if the child is fourteen years or older, they must consent to the adoption in order for it to be approved by the court. There are several types of adoptions. A relative adoption is when an adoption is taking place within a family, such as when a stepparent adopts a spouse’s child. Both natural …

The federal Office of Child Support Enforcement (OCSE) reports that approximately 70% of all child support is collected from the responsible parent via wage withholding or garnishment. While these are very good numbers, the numbers can be even better if the people that tend to slip through the cracks would pony up. The newest program that the OCSE has launched, with help of employers, is the Passport Denial Program. Business Management Daily reports that employers are paying their employees astronomical amounts for their employees to travel out of the country on business. This program will…

The idea of Facebook and other social media websites is to connect people who live far away and have similar interests or friends.  The interesting thing about social media is that it has almost the opposite effect for marriages.  According to the American Academy of Matrimonial Lawyers reported that 80% of lawyers have seen an increase in the word Facebook in divorce filings.  There are two ways in which social media can affect a marriage, before it, by allowing people to flirt with exes and after, by posting inappropriate content during the divorce. The same things that make social …

Premarital agreements are also called prenuptial agreements (“prenups”) and sometimes called antenuptial agreements. The terms are the same. A premarital agreement is a written contract created by two people planning to be married. The agreement typically lists all of the property each person owns, as well as their debts, and states what each person's property rights will be after they marry both in the event of divorce or death. Under the Illinois Uniform Premarital Agreement Act, a prenuptial agreement must be in writing. A prenuptial agreement is also enforceable without consideration…

Unlike some other states, Illinois is not a community property state. Money or property acquired during the course of the marriage is presumed to belong to the marriage and, as such, is subject to an equitable division upon divorce. What is "equitable" is decided on a case-by-case basis. Some examples of the property that is divided in a divorce include homes, automobiles, household furniture and furnishings, bank accounts, pensions and retirement plans, stocks and stock options, businesses and business interests, and even frequent flier miles! In dividing marital property, the Illinois…

US Politics Today has revealed what many of us have known all along about one potential destination for social media: the constant status updates and sharing of information has hit the court house. Social media websites have proven invaluable when seeking information some individuals want to keep secret from ex-spouses and legal representation of exes. Family law cases have shown an increase in the number of instances where social media postings and behavior is called into question in the court arena. People are not always prudent in the things that they say, post and share on social media…

Maintenance, formerly known as alimony, is not mandatory in Illinois like child support is. There is no guarantee when you are going through a divorce that you will either have to pay or receive maintenance. The Illinois statute that governs  that maintenance is 750 ILCS 5/504 (from Ch. 40, par. 504). The law states that maintenance may be granted "...without regard to marital misconduct, in gross or for fixed or indefinite periods of time, and the maintenance may be paid from the income or property of the other spouse after consideration of all relevant factors..." The court considers …

There are many specific and often complex legal rules about adoption. Anyone who wishes to adopt a child should familiarize themselves with these rules and consult a professional lawyer. Not everyone is eligible to adopt; there are special conditions that a person must first meet. First of all, a person, be they man or woman, may adopt a child if they are reputable, of legal age, and under no legal disability. If such person is married and has been living together with his or her spouse at least 12 months, the spouse must be part of the adoption proceedings as well. This also concerns a …
