A University of Michigan report recently released and reported on in U.S. News and World Report found that after divorce a whopping 115,000 women in the U.S. lose their healthcare every year. Gridget Lavelle, a Ph.D. candidate in public policy and sociology said in a news release that, “given that approximately 1 million divorces occur each year in the U.S., and that many women get health coverage through their husbands, the impact is quite substantial.” As if getting a divorce wasn’t worry enough. Lavelle and her colleagues found that 65,000 of the 115,000 women lose all healthcare …

One of the legal requirements of all divorcing couples is that each spouse must openly and honestly disclose all assets, income, expenses, and debt. To many people's demise, they cannot fight the urge to try to lie or cheat in divorce proceedings to hold onto at least some of their assets. These issues are often talked about when divorce comes up, and this is no exception. Forbes reported a story on the phenomenon and issues around it. Usually, it is the husbands that are said to try and hide their assets in divorce. Whether it is the man or the woman, the bag of tricks used in these cases…

Divorce is always hard and if you have children, it can be even more emotionally demanding. As we are just past Halloween, it might be good to look at handling holiday issues when you are separated or newly divorced. The holiday season can be hard to deal with for both children and their separated parents. A blog on psychologytoday.com provided a list of ten hints for the divorced around holidays. The first thing to remember is that the holidays are not all about you. An adult can deal with a different holiday celebration better than a child who has high hopes for their holidays. …

In modern times, people have differed from the traditional ways of doing things. One of these differences is the connection between marriage and religion. Nowadays, it is not uncommon to marry someone who does not share your religious views. This might not be a problem when you are happily married, but especially if you have children, this can cause issues in case of a divorce. The Chicago Tribune did a story about a legal battle over a child's religion a few years back. In the Tribune story, a woman found out via email that her 3-year-old had been baptized in a Catholic church, even …

Multiplatinum hip hop hit producer Scott Storch reportedly is the subject of an arrest warrant for failing to appear at a Florida court proceeding regarding back child support owed to the mother of his child. According to MTV News, Storch owes $28,300 in child support arrearages, and then missed a court date in the ongoing child support proceedings. However, Storch’s attorney, Guy Spiegelman, assured MTV News that his client would take care of the debt by the end of the week. Once the debt is paid, Storch’s attorney anticipates that the court will lift the previously issued arrest warrant…

You have surely heard a lot of stories about divorce and how divorce cases go in court. In today's society, everyone has. It is, however, important to realize that not every story is true, but the exhilarating tales you have heard from your friends and coworkers might actually be completely made up. This post is about clearing a couple misconceived notions about property division in Illinois divorce cases.   Claim #1 : The Illinois Marriage and Dissolution of Marriage Act (IMDMA) requires the courts to divide marital property evenly (50-50). If you look at the actual statutes, …

Premarital, or prenuptial, agreements are raising their popularity as more people want to protect their assets, even when they say ”'til death do us part.” A few decades back, most people thought that prenuptial agreements were only for the wealthy, but as time went by, people realized they might have property they wish to protect. Here are some key aspects of what the Illinois Uniform Premarital Agreement Act says about prenuptial agreements: What is a premarital agreement? A premarital agreement is defined in the Act as ”an agreement between prospective spouses made in …

Since the end of 2006, the unemployment rate in Illinois has doubled from 4.4% to its current rate of 8.8%.  While it is easy to see how people losing their jobs would lead to bankruptcy, there are other strains that can be put on a family when there are financial issues.  A survey conducted by NPR and the Kaiser Family Foundation shows that 1 in 5 people who have been unemployed for a year think that their relationships are negatively affected. Yet as unemployment rates go up, the divorce rate goes down.  People who are not able to pay for food or shelter are less likely to use their …

On the heels of the upcoming elections, there is talk in political circles that gay marriage might become legal in more states.  In 2004, Massachusetts was the first state to formally recognize the rights of those seeking same-sex marriages.  Since then, Connecticut, New Hampshire, Vermont, Iowa, the District of Columbia, and New York have legalized gay marriage.  More states are expected to join in the legalization after this election, including Washington and Maryland.  Especially since the Democratic Party supports gay marriage rights for the first time.  But what happens when these …
