Jurisdiction and Venue in Divorce Cases

Venue is the place, county, or geographical area that an action is brought. Jurisdiction deals with the proper court to hear the case and the court's power to hear the case. For purposes of a divorce action, the action is typically filed in the state where the parties have resided for a period of time prescribed by statute.

Marriage of Underage Children

In most states, a person must be 18 in order to marry; however, in many states a minor 15 years or older may get married with legal permission from a parent or guardian. You have to be 16 to get married with parental consent in the State of New York. If you are under 16, you need a court order giving you permission to marry.

Adoption and Safe Families Act - Permanency Plans and Hearings

The Adoption and Safe Families Act (ASFA) requires states to conduct a permanency hearing within 12 months of a child's placement in foster care and at least every 12 months thereafter for as long as the child is in foster care. The date of the child's placement in foster care is the earlier of the following two dates: the date of the first judicial finding that the child is abused or neglected, or 60 days after the removal of the child from his or her home.

Involuntary Commitment of an Individual

Involuntary commitment of an individual occurs when the individual is ordered to a treatment facility or hospital to prevent them from harming themselves or others. In order for one to be confined against their wishes they must be mentally ill, under the influence of an intoxicant or narcotic, or a danger to themselves of others.

Adoption by a Same-Sex Couple

Any couple that choses to adopt a child must go through a rigorous background check. Often times, it may take many months or years for an adoption to be successfully completed. Although some states permit single individuals to adopt children, most states do not permit the adoption of a child by a same-sex couple.
